Green Island serves as a representative of the Properties Owners. When a Guest confirms a booking of a property a Rental Contract is established between Green Island and the Guest for the period specified in the Rental Contract. By booking a property through Green Island, the Guest agrees to these terms and conditions in relation to the Rental Contract. The Rental Contract only becomes effective once Green Island has confirmed the Guest's booking in writing.
Booking: Upon receiving a request for availability, the applicable villa rates and the required deposit amount will be provided. Bookings are made on a 'first-come, first-served' basis and must meet the minimum nights' requirement for the stay period. Green Island reserves the right to decline a booking request without providing a reason. All rates are subject to 7% regulatory taxes.
Payment:
Initial deposit: an initial deposit of twenty-five percent (25%) must be paid to confirm a booking, unless otherwise specified in the confirmation of availability. This deposit is non-refundable and is due within 5 calendar days of booking. If the initial deposit is not received within 5 calendar days, the reservation will be deemed canceled, and Green Island reserves the right to allocate the villa to another Guest.
Balance payment: payment in full is due forty-five (45) days before guest expected arrival date. No contract will exist between the guest and villa owner until receipt of funds.
Cancellation Policy: Notice of cancellation must be sent in writing and will follow the general cancellation fees below:
• 25% of the total rental amount will be forfeited if the cancellation is made more than 45 days before the start of the rental period.
• 50% of the total rental amount will be forfeited if the cancellation is made between 30 and 45 days before the start of the rental period.
• 100% of the total rental amount will be forfeited if the cancellation is made less than 29 days before the start of the rental period or in case of no show.
Security Deposit: Upon check-in, Guest is requested to pay a security deposit in the amount of twenty thousand Thai Baht (20’000THB). The security deposit may not be used or deducted as rent. Guest will be entitled to a full refund of the security deposit on the date of the check-out if guest returns possession of the Premises in the same condition as accepted and will be liable for any damage occurring to the premises and any damage to or loss of the contents thereof which is done by Guests or guests’ visitors.
Minimum Stay Requirements: There is a minimum stay requirement of 3 days for most of the year. During peak season (20 December to 20 February), the minimum stay is 7 days.
Booking Alteration by Property Owners: Though it is unlikely that the villa Owners will have to make any changes to confirmed arrangements Guest will be informed at the earliest possible date. If, for any reason beyond our control the property is rendered unfit for living the villa Owners will cancel the booking and refund in full the amount already paid by Guest. The villa owner shall not be liable for any further obligations or claims.
Arrival and Departure Times: The designated check-in time is 2:00 PM, with a check-out time of 12:00 PM, unless other arrangements have been made and agreed upon. Early arrivals or late departures are subject to the villa's availability.
Check-In and Check-Out Procedures: Check-in and check-out are conducted in person. Guests must notify at least 24 hours in advance of their expected check-in and check-out times. A premises inspection will be carried out both at the time of check-in and check-out.
Registered Guests: Only the number of Guests specified in the Rental Agreement at the time of booking may reside on the premises. The maximum number of Guests allowed is as stated in the booking. If additional Guests are discovered, Owners or their representatives have the discretion to ask the extra person or persons to leave the premises and a penalty fee of ten thousand Bath (10’000 THB) will be applied.
Use of Premises: The Premises will be used only for residential purposes and for a stay of the maximum number of Guests mentioned in the Rental Agreement. Guests will not engage in any activities which will make the Premises less fit to live in, will cause dangerous, hazardous, or unsanitary conditions or will interfere with the rights of others to enjoy their property. Guests will be liable for any damage occurring to the Premises and any damage to or loss of the contents thereof which is done by Guests.
Utilities: all utility costs are covered by the rental costs (internet, water and electricity). Guests are required to ensure windows remain closed when air-conditioning is in operation and to switch off lights and air-conditioning when leaving the villa or spending extended periods outside.
Taxi transfer from pier: Taxis can be arranged for both check-in and check-out from arrival/departure Pier. Guests must provide notice at least 24 hours in advance, specifying the pier of arrival and the expected hour of arrival. The cost of the taxi service is calculated per taxi and must be paid directly by the guest to the taxi driver.
Cleaning and Linen Change: Cleaning and linen change are provided free of charge every seven days. Additional cleaning and linen change can be organized for a fee (500THB per hour for cleaning and laundry charge) if requested by Guests.
Access to Maintenance Staff: Guests are required to allow access to the property to maintenance staff for regular gardening and pool maintenance services and other maintenance needs.
Assignment and Subletting: Guests will not assign the Rental Agreement as to any portion or all of the Premises or make or permit any total or partial sublease or other transfer of any portion or all of the Premises. This situation would be an immediate cause of breach of the Rental Agreement.
Smoking: Smoking is not permitted inside the Villas. Guests shall use outdoor space of the premises.
Pets: Guests are not allowed to have pets on the Premises.
Noise: Guests are required to refrain from any excessively loud or improper noises or otherwise disturb other residents in the immediate area and shall respect quiet hours from 10PM to 7AM.
Events: Properties are solely for residential purposes. Commercial activities, gatherings and events (parties, workshops, etc.) are not permitted on property premises.
Due Care, Supervision and Insurance: Guests accept and acknowledge that they are responsible and liable for the safety and well-being of all Guests and third parties staying at the premises during the time of the rental. The Guests are required to take due care when residing at the villa. Children must be always under the direct supervision of an adult. Damage or injury resulting from the above-mentioned shall not be the responsibility of Property Owners or their representatives. Guests accept, acknowledge and hold owners or their representatives harmless from and against any liability resulting from any claims whatsoever as a consequence of accidents leading to injury or loss of life of any guests or visitors. Guests are advised to have both liability and comprehensive travel insurance as well as appropriate heath insurance. Property Owners and their representatives are not responsible to Guests and visitors for any claims including any accidents related to the use of the property facilities or locally procured third party services such as water sports and vehicles rentals.
Force Majeure: Property Owners or their representatives cannot be held liable for any delays, inconveniences, or expenses arising directly or indirectly from incidents such as fires, floods, severe weather, civil disturbances, Acts of God, or any other events beyond their control.
Complaints: Should any issues or complaints arise during their stay, Guests are required to contact the assigned focal point at the earliest who will endeavor to rectify the situation as soon as possible to the best of their ability and available resources. It is also understood that staying in a less developed and remote island location may mean that immediate availability of resources may not match those of urban environments. Please note that the Owners and their representatives are not liable for interruptions to public services, water supply, electricity, Internet connection or breakdowns of pool filtration systems.
Conduct Behavior: Guests are required to ensure proper care of the premises, maintain appropriate behavior during their stay and are prohibited from unlawful behavior such as the use or possession of illegal items and substances. The Owners or their representatives at their absolute discretion, may ask the offending party to leave the premises. In this case, no refund may be claimed by the Guests.
Governing Law: The terms of the Rental Agreement and the rights and obligations of the parties are governed by the laws of Thailand.
